KERSHENSTINE BEEF JERKY, INC. TERMS AND CONDITIONS
As an INDEPENDENT AFFILIATE there is no purchase of product required to buy retail. To become a WHOLESALE INDEPENDENT AFFILIATE (WIA), it is required to pay a $49 processing fee (Includes your Back Office) and make an initial minimum order of $100.
I understand as an Independent Affiliate or WHOLESALE INDEPENDENT AFFILIATE, hereby known as a WAI as outlined in the Terms and Conditions as presented, are not an employee, agent or legal representative of Kershenstine Beef Jerky, Inc., for any purpose whatsoever. I will be responsible for my own business. I agree to obey all laws pertaining to the operation of my independent business and I will comply with all regulatory agencies and remit any, and all applicable taxes, (local, state, federal, personal or business). I have a valid Social Security Number or Federal Tax ID.
WHOLESALE INDEPENDENT AFFILIATE’s Business cannot be sold, assigned, or transferred without prior written approval of Kershenstine Beef Jerky, Inc. However, consent will not be unreasonably withheld.
I may give up my rights as a WHOLESALE INDEPENDENT AFFILIATE upon written notice to the company regardless of reason. I hereby agree to represent the Kershenstine Beef Jerky, Inc. Retail Business Model fairly and completely, emphasizing that retail sales are a requirement to receive compensation through the Kershenstine Beef Jerky, Inc. Retail Business Model. Kershenstine Beef Jerky, Inc. Retail Business Model is built on retail sales to the ultimate consumer. Furthermore, the WHOLESALE INDEPENDENT AFFILIATE must make 10 retail sales each month to receive organizational commissions; upon requested by company, WHOLESALE INDEPENDENT AFFILIATE must provide retail customer list; I may lose my rights as a WHOLESALE INDEPENDENT AFFILIATE for failure to comply with this requirement. I understand that no earnings are guaranteed from participation in the Retail Business Model.
I must abide by all the rules and regulations outlined in the Terms and Conditions, Retail Business Model, and any changes announced by the company. Annual Renewal Fee: WHOLESALE INDEPENDENT AFFILIATE will be charged a $25.00 Annual Renewal Fee to remain active on the Kershenstine Beef Jerky, Inc. computers. This fee is due and payable after the anniversary date of Joining. If this renewal fee is not paid prior to expiration, Kershenstine Beef Jerky, Inc. reserves the right to remove WHOLESALE INDEPENDENT AFFILIATE from the computer.
I will not use the name Kershenstine Beef Jerky, Inc. or any of its affiliate names or product names, its trademarks, or logos without prior written approval from the company. Furthermore, I will not use affiliate names or register any websites, such as Amazon, eBay or any other online sites using the company’s name(s), its products, or its information. Furthermore, I will not use Kershenstine Beef Jerky, Inc. Internet marking material, logo, or any trade names for my own website, other than materials that are provided in the Back Office for the WHOLESALE INDEPENDENT AFFILAITE to use to build the business.
I understand the foundation of the Kershenstine Beef Jerky, Inc. Retail Business Model is sales at retail.
I certify that I am of the age of majority.
I understand and agree that except as set forth herein, all claims and disputes relating to this agreement, the rights and obligations of the parties or any other claims or causes of action relating to the performance of either party under this agreement, shall be settled totally and finally by arbitration in the City Eupora, State of Mississippi, in accordance with the Federal Arbitration Act and the Commercial Rules of the American Arbitration Association.
Changes to the Retail Business Model as the business environment periodically change, Kershenstine Beef Jerky, Inc. reserves the right to amend the Retail Business Model, its prices. and its Terms and Conditions, in its sole and absolute discretion. Kershenstine Beef Jerky, Inc, also reserves the right to terminate it’s affliate program and seize all earnings at any time, at it’s discretion.
Kershenstine Beef Jerky, Inc. shall not be responsible for acts beyond its control, including, but not limited to fire, flood, earthquakes, power outage, labor difficulty, equipment failure, supplier problems, or other difficulties that might prevent performance of an order, commission payments or contents according to the Terms and Conditions.
Bonus and Commission: Qualifications for a WHOLESALE INDEPENDENT AFFILIATE must be active, $100 per month and making retails sales in to qualify for bonuses and commissions.
Commercial Outlets: Independent Affiliate and WHOLESALE INDEPENDENT AFFILIATE may not sell Kershenstine Beef Jerky, Inc. Products from a commercial outlet, nor may display or sell products in any retail convenient stores or service establishments.
Inventory Loading: WHOLESALE INDEPENDENT AFFILIATE must never purchase more products than they can reasonably use or sell to retail customers in a month, and must not influence or attempt to influence any other WHOLESALE INDEPENDENT AFFILIATE to buy more products than they can reasonably use or sell to retail customers in a month.
Product Guarantee: Kershenstine Beef Jerky, Inc. offers a 10-day money-back satisfaction guarantee (less shipping charges and fees) to all Customers and Independent Affiliate or WHOLESALE INDEPENDENT AFFILIATE who purchase products directly from the company. Note, if any commissions were paid on the returned product, commissions if applicable, will be deducted.
Cancellation Due to Inactivity: If a WHOLESALE INDEPENDENT AFFILIATE has not purchased product or have qualifying personal volume for six consecutive months (and thus become “inactive”), his or her account shall be canceled for inactivity.
Sales team retail volume is calculated from the 1st to the end of the month. Commissions will be paid on the 5th of the following the month.
